17th Circuit Court

Adult Adoptions

An adult adoption occurs when the individual being adopted is 18 years of age or older.

Please note that if you are a stepparent but no longer married to the child's legal parent, - the adoption will remove that parent from the birth certificate.

If you are currently the stepparent, the biological parent will also need to be a petitioner.

Parental rights are not required to be terminated in an adult adoption; however, for the court to enter an order of adoption the following must occur:

Requirements

  • The person to be adopted consents to the adoption according to [MCL 710.43(3)].
  • The written report of investigation required by [MCL 710.46(2)] is filed. This will be completed by the adoption caseworker.
  • Notice to be served upon interested parties described in [MCL 710.24a]. MCL 710.56(5). It is the responsibility of the petitioner/s to provide the information of the biological parent/s to be noticed.
